This privacy policy (“Policy” or “Privacy Policy”) explains how Consark Inc., Consark LLP, Consark Advisory Services LLP or any of its affiliates or subsidiaries (together “We”, “Us”, “Our” or “Consark”) process Personal Data collected from You.
We give utmost respect to the privacy of data provided by the users of our software application (“user” or “you”) and insist upon the highest standards for secure transactions and privacy of user information. However, we only act as a service provider to our users and may process and store personal information that our users provide, under the privacy policy of our software application, but do not own whole or part of the information.
By using the Consark’s software application and our services, you agree to our use of your personal information (including sensitive personal information) in accordance with this Privacy Policy, as may be amended from time to time by us at our discretion. This Privacy Policy also applies to personal and possibly non-personal yet proprietary or confidential information of your customers/clients/contacts that you collect using the Consark software application. Software application referenced in this Privacy Policy includes the Consark online/web platform and the Consark website ( including subdomains. You also agree and consent to us collecting, storing, processing, and transferring your personal information for the purposes set out in this Privacy Policy. Please read the following to understand our information gathering and dissemination practices.
For the sake of this Privacy Policy, the terms “user” and “you” shall refer to both the company which is the customer of Consark and the company’s representatives who have been provided access to the software application as users, and wherever the context so requires, shall be interpreted accordingly, including to mean either jointly or severally.
1. COLLECTING INFORMATION
We collect personal information from you such as your name (company/entity name, contact person’s/company representative’s name), contact number, email address, and postal address, to set up and authenticate your profile when you sign up with us on the Consark software application and demographic data such as location and time zone when you are using the Consark software application. For certain customers subscribing to certain features of the Consark software application, we collect non-public financial information concerning the customer’s or its related party’s assets, liabilities, credit, accounts and balances, transactional information, such as, without limitation, audited financial statements, forecasts, latest trial balance, management accounts (MIS), agreements relating to mergers & acquisition (Shareholder’s Agreements, Share Purchase Agreements etc.), earnout/Operating Profit After Tax (OPAT) computation workings, etc.
All aforementioned personal information shall hereinafter be collectively referred to as “Personal Information”. We use your personal information to enable you to use our software application, operate our software application, ensure the security of our software application, improve and optimise the operation and performance of our software application, diagnose problems with and identify any security risks, errors, or needed enhancements to the software application, detect and prevent fraud and abuse of our software application and systems, collecting aggregate statistics about use of our software application, understand and analyse how you use our software application so as to customise your user experience.
As the Consark software application enables exchanging information and data through the application, you may use the Consark software application to gather and store personal and/or non-personal yet possibly proprietary/confidential information from your customers/clients/contacts. In such cases, you are entirely responsible for the safety and privacy of the personal and/or proprietary/confidential information collected and stored by you. You further agree and undertake to inform the customer/client/contact from whom such information is collected about the safety and privacy of their information. You also agree that we shall not be, in any way, responsible or liable for the safety and privacy of the personal and/or proprietary information collected and stored by you using the Consark software application and shall indemnify us from any/all claims, liabilities, costs, suits, and consequences arising out of the collection and storage of such information.
We may also gather some information about your visit, such as IP address, operating system, domain servers, and date and time of your access; this information will not identify you personally and will not be linked back to you.
2. INFORMATION USE AND DISCLOSURE
We will not share your Personal Information with other parties, and we will preserve your Personal Information in a highly confidential manner. In the event there arises a need to share certain information with Authorized Third-Party Service Providers, we will seek for their compliance with this Privacy Policy with regard to handling of your Personal Information.
We use your Personal Information to manage your account, to contact you and to operate, as well as enhance the operation of the software application, provide alerts to you on latest features, improve our marketing and promotional efforts, analyse software application usage, and improve upon our software application to provide you a better user experience.
In the event of a sale, merger, public offering, other change in control of Consark LLP, your information may be shared with the person or business that owns or controls the software application. Opting out of receiving information will not affect our right to transfer your information to a new owner, but your choices will continue to be respected regarding the use of your information.
3. USE OF DEMOGRAPHIC AND PROFILE DATA
We use your Personal Information to provide the services you request, resolve disputes and troubleshoot problems, help in promoting a safe service, collect fees owed, measure user interest in our software application, inform you about online and offline offers, products, services, and updates, customise your experience, detect and protect us against error, fraud and other criminal activity and enforce our terms and conditions; and as otherwise described to you at the time of collection. To the extent we use your Personal Information to market to you, we will provide you the ability to opt-out of such uses. In our efforts to continually improve our product and service offerings, we collect and analyse demographic and profile data about our users’ activity on our software applications. We identify and use your IP address to help diagnose problems with our server, and to administer our software application. Your IP address is also used to help identify you and to gather broad demographic information. On some occasions we require you to complete optional online surveys. These surveys may ask you for contact information and demographic information (like pin code). We use this data to tailor your experience with our software application and to find user interest and review our software application and services. At no time will we sell your personal data without your permission unless set forth in this Privacy Policy.
4. STORING AND RETENTION OF INFORMATION
We store your Personal Information either in the Amazon Web Services (AWS) cloud or on One Drive, both of which meet similar standards for maintaining an individual’s right to privacy. AWS’s and OneDrive’s privacy policies can be accessed on their respective official websites. We keep your Personal Information to enable your continued use of our services even if you uninstall and/or cease to use the Consark software application, for as long as it is required to fulfil the relevant purposes described in this Privacy Policy, as may be required by law (including for tax and accounting purposes), or as otherwise communicated to you. How long we retain specific Personal Information varies depending on the purpose of its use, and we will delete your Personal Information in accordance with applicable law. However, if at any point you do not want us to retain your Personal Information, you can write to the Grievance Officer whose details are mentioned herein below, requesting for deletion of your Personal Information from our records.
For those customers using the Consark software application for exchanging information with their customers/clients/contacts, depending on your subscription model, we provide you the option of either storing the personal and/or proprietary/confidential information collected by you on our server hosted on the AWS cloud/OneDrive or enabling you to link your personal cloud storage platform to the Consark software application whereby the information collected can be stored directly in your personal cloud storage drive. When information is stored on your personal cloud storage drive, you are entirely responsible for the safety and privacy of the personal and/or proprietary/confidential information stored therein. You further agree and undertake to inform the customer/client/contact whose information is stored by you, about the safety and privacy standards maintained by you in respect of their personal and/or proprietary/confidential information. You also agree that we shall not be, in any way, responsible or liable for the safety and privacy of the personal and/or proprietary information stored by you in your personal cloud storage drive, and shall indemnify us from any/all claims, liabilities, costs, suits, and consequences arising out of the storage of such information in your personal cloud storage drive. When information collected by you is stored on our server, it is retained until deleted by you. You acknowledge and agree that it is your responsibility to take the consent of the customer/client/contact whose information you collect, to store their information in our server, prior to such storage. You further agree and undertake to delete such information stored in our server after it has served its relevant purpose. In case the customer/client/contact whose information you store in our server wishes for the same to be deleted, you undertake to inform us of the same in writing immediately.
5. BROWSER USAGE AND COOKIES
From time to time, we may place “cookies” on your personal computer. “Cookies” are small identifiers sent from a web server and stored on your computer’s hard drive. www.consark.ai site uses cookies that are necessary for the website to function, and these cookies do not store any personally identifiable information. www.consark.ai may also use cookies to keep track of your session and advertising delivery. This site also uses cookies to deliver content specific to your interests and to save your password. You have the ability to accept or decline cookies. If you choose to decline cookies certain features of the website may not function properly or at all as a result.
6. LINKS TO OTHER SITES
Our software application links to other platforms in good faith for promotional/publicity & advertisement purposes (Facebook, LinkedIn, YouTube, Instagram & Twitter) and we will make a reasonable effort to link only to sites that meet similar standards for maintaining an individual’s right to privacy. However, many other sites that are not associated or authorized by Consark may have links leading to our software application. We cannot control these links and we disclaim any responsibility for the materials contained in any website linked to our software application. Therefore, we encourage you to read the individual privacy statements of such websites.
7. SECURITY PRECAUTIONS
We safeguard your privacy using known security standards and procedures and comply with applicable privacy laws. Our software application combines industry-approved physical, electronic and procedural safeguards to ensure that your information is well protected through its life cycle in our infrastructure. We take all reasonable steps to protect your Personal Information from misuse, loss, unauthorised access, modification or disclosure and alteration of the information under our control. Sensitive data is hashed or encrypted when it is stored in our infrastructure. Sensitive data is decrypted, processed and immediately re-encrypted or discarded when no longer necessary. We host web services in audited data centres, with restricted access to the data processing servers. Whenever you change or access your account information, we offer the use of a secure server.
As mentioned above, we store your Personal Information in the AWS cloud, which is also designed with your security and privacy in mind. How AWS maintains and protects the security and privacy of Personal Information can be learnt from its privacy policy available on its official website.
8. AMENDMENTS
We may amend this policy at any time without giving any intimation of whatsoever nature. At that time, we will notify by posting a notice on our software application or sending you an email on your registered email address.
9. GRIEVANCE REDRESSAL
You have a right to correct any errors in your Personal Information available with us. You may request to us in writing that we cease to use your Personal Information.
In case you are of the opinion that we are in violation of any of the provisions of this Privacy Policy, you may write to our Grievance Redressal Officer via email on security at consark dot ai.
